Today, a detailed paper that I co-authored with my colleague Nora-Marie Fuchs was published on the pending case before the CJEU concerning Meta, the DMA, and the so-called “Pay or Consent” model.
In our analysis, we demonstrate that even the very term “Pay or Consent” is misleading, and that the debate risks being steered in the wrong direction – to Meta’s detriment – because of this framing.
