Successful disputation on Derrida

Bernhard Gaertner’s dissertation on Derrida and the law is a remarkably independent contribution to contemporary philosophy of law. It combines the deconstructive theory Jacques Derrida with precise legal argumentation and shows that the examination of textuality, decision and justice does not have to be limited to the abstract, but can have dogmatic and methodological consequences for the law.

The fact that the work has consistently followed its path despite considerable reservations – especially from the methodologically more formalized auxiliary disciplines – speaks for its argumentative substance and intellectual independence. The defensio at the ITM (28.2.) impressively demonstrated that not only philosophical erudition, but also analytical acuity and legal-systematic sensitivity come together here.

This work is a contribution that takes the legal-philosophical discourse seriously without losing sight of legal practice – and this is precisely where its particular strength lies.
