At the XX CODAIP conference on November 4, 2026, Professor Thomas Hoeren explored the boundaries of AI training under European copyright law. His lecture examined text and data mining, the LAION litigation, and the GEMA proceedings against OpenAI and Suno, alongside Advocate General Szpunar\u2019s Opinion of November 3 in Like Company (C-250\/25).<\/p>\n

Szpunar considers LLM training to generally qualify for the text and data mining exception, although he proposes declaring the training questions inadmissible in this case. His primary focus is on real-time retrieval and reuse: chatbot responses may infringe on the rights of news publishers when they reproduce recognizable expressions to such an extent that they serve as a substitute for reading the original publication. Mere facts remain unprotected. The Opinion is not binding; the Court\u2019s judgment is still pending.<\/p>\n

A central theme of the lecture was the distinction between collecting training data, memorizing protected expression, and generating outputs. Each stage raises different legal questions\u2014and understanding the technology is essential to answering them.<\/p>\n
