Successful exchange: ITM meets the “Digital Restart” project launched by the NRW Ministry of Justice

Prof. Dr. Hoeren, other members of staff from the “ABIDA” and “DFN” projects(https://www.dfn.de/) and representatives of the NRW Ministry of Justice engaged in a lively exchange about the overlaps in content between the two projects based at the ITM and the NRW Ministry of Justice. Under the heading “Does our law need an update?”, the “Digital Restart” project is investigating the extent to which the German Civil Code (BGB), as the central legal basis for private law relationships, is still up to the challenges of advancing digitalization. First, information on the actual effects of digitalization from the perspective of those affected will be collected, which will then be used to identify regulatory gaps and approaches for legislative measures with regard to existing civil law regulations. In terms of content, there are numerous common issues with the aforementioned projects at the ITM. The discussions focused on topics such as “Data in insolvency”, the “Right to be forgotten” and “Warranty when purchasing digital goods”, which were already examined as part of “ABIDA”.

Both sides felt that the exchange was a success and look forward to further fruitful communication and successful cooperation in the future.
